As you may have read in the papers and online, Wells Fargo has been opening unauthorized credit and debit card accounts and bank accounts in the name of its banking customers. This is outrageous, fraudulent conduct. Wells Fargo has already agreed to pay the Consumer Financial Protection Bureau (CFPB) a civil penalty of $100 million due to its fraudulent conduct. The Consent Order that Wells Fargo entered into with the CFPB can be seen here. But, that money won’t go to the victims. The victims may get paid back the fees Wells Fargo charged them as a result of its conduct, but they won’t get punitive damages.
