Shapiro Haber & Urmy LLP Has Determined That Kalshi Is Violating the Gambling Laws of Massachusetts by Taking Sports Bets Without a License.
Shapiro Haber & Urmy LLP has also determined that people who have placed sports bets on Kalshi and lost money may have valuable claims against Kalshi to recover their sports betting losses.
The Massachusetts Attorney General recently brought litigation against Kalshi for violating the Commonwealth’s sports wagering laws by offering sports wagering to Massachusetts residents even though Kalshi does not have a Massachusetts Gaming License. That action, filed in Massachusetts Superior Court, is called Commonwealth of Massachusetts v. Kalshi, LLC. The Commonwealth’s complaint against Kalshi can be found here. In that case, the Court ruled that the Commonwealth could enforce its Sports Gambling law against Kalshi and that the Commonwealth was likely to succeed on its claim that Kalshi could not take sports bets in Massachusetts without a license under the Massachusetts Sports Wagering law. The Court also found that the Commonwealth was likely to prevail on its claim that Kalshi was violating the Massachusetts Sports Wagering law. Accordingly, the Court entered a preliminary injunction against Kalshi. A copy of the Court’s decision can be found here. Kalshi has appealed the Court’s decision against it and the injunction has not yet gone into effect pending that appeal.
