Shapiro Haber & Urmy LLP Files
Suit Against John Hancock Life
Insurance Company on Behalf of
Charters, Heck, O’Donnell &
Petrulis, P.C.
The
law firm of Shapiro Haber & Urmy
LLP has filed a class action
against John Hancock Life
Insurance Company in the United
States District Court in
Massachusetts on behalf of
John. P. Charters and the
"trustees, sponsors and
administrators" of the 401(k)
plan of Charters, Heck,
O’Donnell & Petrulis, P.C., a
law firm based in Troy,
Michigan.
The complaint, filed on July 26,
2007 alleges that Hancock
violated the Employee Retirement
Income Security Act (“ERISA”)
by overcharging for their
services and also for
accepting payments from third
party mutual funds for their own
benefit. The complaint
alleges that, as a result of
these actions, Hancock was
overpaid for the services it was
originally contracted to
provide, resulting in a
diminishment of the assets of
the firm's plan.
