Securities Class Action Suit Filed Against ING Funds

The firm of Shapiro Haber & Urmy LLP is prosecuting an action in the United States District Court for the District of Massachusetts, alleging breach of fiduciary duty against ING Investments, LLC and ING Investment Management Co., formerly known as Aeltus Investment Management, Inc.

This is an action brought by the plaintiffs on behalf of ING Principal Protection Fund, ING Principal Protection Fund II and ING Principal Protection Fund IV (collectively referred to as the "Funds"), for breach by the defendants of their fiduciary duty to the Funds and the Funds’ shareholders and for violation of Section 36(b) of the Investment Company Act of 1940, 15 U.S.C. §80a-35(b). The complaint alleges that the defendants have breached their fiduciary duty to the Funds and their shareholders by approving, charging, and receiving the payment by the Funds of advisory fees which are excessive. Plaintiffs seek recovery for the Funds, from the defendants, the excessive fees paid by the Funds to the defendants.

We believe that the other Principal Protection Funds have similar claims.  If you are a shareholder in ING Principal Protection Fund III and ING Principal Protection Funds V through XII, we would very much like to discuss this matter with you.
