Todd Heyman is a partner at Shapiro Haber & Urmy LLP. He has been named a Massachusetts Rising Star in the field of employment litigation. Although his practice focuses primarily on employee wage litigation and consumer litigation, he also represents investors in securities litigation and works on several of the firm's antitrust cases.
Working with counsel admitted to practice in other jurisdictions, he has represented employees throughout the United States, including computer programmers, computer graphics artists, insurance adjusters, retail store employees, car wash workers, cable technicians, manufacturing plant workers, among others. Several of his cases have resulted in multi-million dollar settlements for employees who were not paid overtime wages, including two settlements for approximately 15 million dollars for employees working in the video game industry.
Todd regularly provides presentations and trainings on state and federal wage laws and class actions, including as part of continuing legal education programs.
In consumer litigation, Todd has successfully argued before the Massachusetts Supreme Judicial Court in Aspinall v. Philip Morris and the United States Court of Appeals for the First Circuit in Altria v. Good that state law consumer protection claims against the tobacco companies are not preempted by federal law. The decision of the First Circuit was affirmed by the United States Supreme Court, and Todd was on the brief and helped prepare the case for oral argument.
In securities litigation, he argued several cases which resulted in important decisions in Swack v. Credit Suisse First Boston and In re Credit Suisse-AOL Securities Litigation that address what facts must be proved to establish that fraudulent conduct caused an investor's losses.
Prior to joining Shapiro Haber & Urmy LLP, Todd worked as a law clerk for the Honorable Nancy Gertner, United States District Judge for the District of Massachusetts (1999-2000).
Todd speaks fluent Spanish and often represents Spanish-speaking individuals and low-income workers on a reduced fee basis. In one case, he obtained a recovery of over $30,000 for a Peruvian refugee who had not been paid all her wages while working as a nanny.
