Shapiro Haber & Urmy LLP is currently investigating excessive or unfair overdraft fees that result from some banks’ practice of reordering transactions so as to maximize the number of overdrafts from a customer’s account. For example, when a bank posts transactions from largest to smallest amounts, the customer’s account balance becomes depleted such that subsequent small transactions result in numerous overdraft fees. This “biggest check first” policy has been a common practice among many banks in the United States. Courts have recognized that the way in which banks charge overdraft fees can be unfair to the consumer, even if the bank disclosed these overdraft policies in fine print or if the consumer opted into the bank’s overdraft protection program.
